General Terms and Conditions of 4GOLD

Article 1. Definitions

For the purposes of these General Terms and Conditions, the following definitions shall apply:

  • 4GOLD: Nutribam, a limited liability company under Belgian law, with registered office at Wechelsebaan 73A, 2275 Lille, Belgium, registered with the Crossroads Bank for Enterprises under number 0674.721.904 (RPR Antwerp, Antwerp Division);

  • General Terms and Conditions: these general terms and conditions of 4Gold;

  • Customer: any natural or legal person purchasing one or more Products or Services through 4GOLD;

  • Consumer: any natural person acting for purposes outside their trade, business, craft or profession who concludes an Agreement with 4GOLD;

  • Agreement: the agreement concluded between 4Gold and the Customer concerning the purchase of Products or Services directly provided by 4GOLD, including a Gut Support Subscription;

  • Products: all products offered and sold by 4GOLD through the Webshop;

  • Services: services provided directly by 4GOLD, including the Gut Support Subscription, but excluding Third-Party Services;

  • Gut Support Subscription: the recurring subscription service offered by 4GOLD under which the Customer receives the Products specified on the Website at the applicable recurring price and delivery frequency;

  • Third-Party Services: products and/or services provided by a third party and offered or made available through the Webshop, where the relevant third party is identified as the contracting party;

  • Superhlth: Superhlth.com, the third-party provider and contracting party for the DNA analysis services offered through the 4GOLD Webshop;

  • Webshop: the online shop operated by 4GOLD through the Website;

  • Website: the website operated by 4GOLD and available at https://www.4gold.eu;

  • Personal Data: personal data processed by 4GOLD in connection with the Customer's purchase, account, subscription, delivery or use of the Website;

  • Privacy Policy: the privacy policy of 4GOLD, as made available on the Website.

Article 2. General

These General Terms and Conditions apply to every offer made by 4Gold and to every Agreement concluded between 4Gold and the Customer concerning the purchase of Products or Services directly provided by 4Gold, unless expressly agreed otherwise in writing.

The General Terms and Conditions are made available to the Customer before the Customer is required to confirm an order.

The contractual relationship between 4Gold and the Customer is governed, in descending order of priority, by:

  1. any written and signed specific agreement;

  2. the applicable order confirmation;

  3. these General Terms and Conditions; and

  4. Belgian law.

Where a specific provision relating to a Product, subscription or promotion conflicts with these General Terms and Conditions, the specific provision shall prevail to the extent of the conflict.

These General Terms and Conditions do not affect any mandatory rights granted to Consumers under applicable consumer protection legislation.

If any provision of these General Terms and Conditions is declared invalid, unlawful or unenforceable, this shall not affect the validity of the remaining provisions. The relevant provision shall, to the extent legally permissible, be interpreted or reduced so as to reflect as closely as possible the original intention of the parties.

Article 3. Offers and Orders

4Gold endeavours to provide a complete and accurate description of its Products and Services on the Website.

Images, descriptions, nutritional information, quantities, characteristics and other information concerning Products are intended to provide an accurate representation of the Products.

4Gold reserves the right to correct obvious errors in prices, descriptions or other information on the Website.

The Customer places an order by completing the ordering process on the Webshop and confirming the order.

An Agreement is concluded when 4Gold electronically confirms the Customer's order, subject to availability of the relevant Product or Service and successful payment or payment authorisation.

The Customer will receive an electronic order confirmation containing the relevant order information and, where applicable, an order number.

4Gold reserves the right to refuse or cancel an order in objectively justified circumstances, including suspected fraud, payment problems, obvious pricing or product errors, or unavailability of the relevant Product.

If 4Gold cancels an order after payment has already been made, the amount paid for the cancelled order will be refunded.

Article 4. Prices and Payment

Unless otherwise stated, all prices displayed on the Webshop are expressed in euros and include VAT applicable at the time of purchase.

Shipping costs and any other additional costs are indicated separately before the Customer completes the order.

The Customer will be informed of the total amount payable, including applicable taxes, shipping costs and other mandatory charges, before placing the order.

4Gold may change its prices at any time. Price changes do not affect orders already accepted by 4Gold.

Orders may be paid using the payment methods made available on the Webshop.

Online orders must be paid using one of the payment methods indicated during the ordering process.

4Gold may use third-party payment service providers, including Mollie, Shopify Payments or other payment providers.

Payment information may be processed directly by these payment service providers in accordance with their own terms and privacy policies. 4Gold does not have access to full payment card details where such information is processed directly by the payment provider.

The Customer acknowledges that payment service providers may apply their own terms and conditions.

Unless expressly stated otherwise, discount codes and promotional offers cannot be combined with other discounts, promotions or offers.

Article 5. Delivery

4Gold will deliver Products to the delivery address provided by the Customer during the ordering process.

If the Products are in stock, 4Gold will endeavour to dispatch them within the period indicated on the Website or in the order confirmation.

The Customer will receive an order confirmation and, where applicable, tracking information from the logistics provider used by 4Gold.

Unless a different delivery period has been agreed, Products shall be delivered within the period required by applicable law.

If delivery is delayed, 4Gold will inform the Customer where reasonably possible.

4Gold shall not be liable for delays caused by circumstances beyond its reasonable control, including delays caused by carriers or other third parties, without prejudice to mandatory rights of Consumers.

If a Product becomes unavailable after the order has been accepted, 4Gold will inform the Customer and refund any amount already paid for the unavailable Product.

Article 6. Products and Use

The Customer is responsible for using and storing Products in accordance with the instructions, warnings, storage conditions and other information provided on the packaging or Website.

The Customer must comply with any applicable instructions concerning dosage, preparation, storage and consumption.

4Gold shall not be responsible for damage resulting from improper use, improper storage, failure to follow instructions or warnings, or use of a Product for a purpose for which it was not intended, except where mandatory law provides otherwise.

Information provided by 4Gold concerning Products, nutrition, performance, health or wellbeing is intended for general informational purposes and does not constitute medical advice or a medical diagnosis.

Products offered by 4Gold are not intended to diagnose, treat, cure or prevent diseases unless explicitly indicated otherwise and legally permitted.

Customers with specific medical questions, medical conditions, allergies, intolerances or concerns regarding the use of a Product should consult an appropriately qualified healthcare professional before using the Product.

Article 7. Gut Support Subscription

4Gold offers a recurring subscription under the name Gut Support Subscription.

The Products included in the Gut Support Subscription, the quantity, recurring price, delivery frequency and any applicable promotional conditions are indicated on the Website at the time the Customer subscribes.

Unless expressly stated otherwise on the Website, the Gut Support Subscription has no minimum subscription period.

By subscribing, the Customer expressly agrees that the applicable subscription amount will be charged automatically at the applicable billing frequency using the selected payment method.

The subscription automatically renews for successive subscription periods unless the Customer cancels the subscription before the next billing date.

The Customer may cancel the Gut Support Subscription at any time using the cancellation method made available by 4Gold or by contacting 4Gold through the contact details provided on the Website.

Cancellation will take effect for the next subscription period and does not affect Products that have already been processed or shipped.

If the Customer cancels after a new subscription period has already started, the subscription fee for that period remains payable, subject to any mandatory statutory rights, including the applicable right of withdrawal.

If a payment cannot be successfully processed, 4Gold may suspend the subscription and request payment of the outstanding amount. If the payment remains unsuccessful, 4Gold may terminate the subscription, subject to applicable law.

4Gold may change the price of the Gut Support Subscription for future subscription periods. Any price increase will be communicated to the Customer in advance and will only apply to future subscription periods. Where required by law, the Customer may cancel the subscription before the new price takes effect.

If 4Gold materially changes the Products included in the Gut Support Subscription or materially changes the essential characteristics of the subscription, the Customer will be informed where required by law.

Article 8. Third-Party Services and DNA Analysis

4Gold may offer certain Products or Services through its Webshop that are provided by third parties.

Where a Product or Service is expressly identified on the Website as a third-party service, the Customer acknowledges that the relevant third party, and not 4Gold, is the contracting party for that service.

DNA Analysis

4Gold may offer DNA analysis services through its Webshop that are provided by Superhlth.

For the avoidance of doubt, Superhlth is the contracting party for the DNA analysis service.

The purchase of a DNA analysis through the 4Gold Webshop therefore results in an agreement between the Customer and Superhlth in relation to the DNA analysis service, subject to the applicable terms and conditions of Superhlth.

4Gold acts as a sales or distribution channel for the DNA analysis service and does not itself perform the DNA analysis.

The provision, performance and interpretation of the DNA analysis, the processing of DNA samples, the generation and provision of DNA results and other aspects of the DNA analysis service are the responsibility of Superhlth and/or its designated partners.

The Customer acknowledges that 4Gold does not act as a medical laboratory, physician, genetic counsellor or other healthcare professional in connection with the DNA analysis.

The DNA analysis and any results provided as part of the service are intended for informational purposes and do not constitute a medical diagnosis, treatment or prevention of disease and are not intended to replace professional medical advice.

Customers should consult an appropriately qualified healthcare professional regarding medical questions or decisions based on DNA results.

The processing of genetic data, DNA samples and other personal data in connection with the DNA analysis is governed by the applicable privacy information and terms of Superhlth.

The Customer is advised to review the applicable Superhlth terms and privacy policy before purchasing the DNA analysis.

Any questions, complaints or requests relating specifically to the DNA analysis, the DNA sample, the analysis itself, the DNA results or the processing of genetic data should be addressed to Superhlth using the contact details provided by Superhlth.

To the extent permitted by applicable law, 4Gold shall not be responsible for the performance, quality, accuracy, availability or results of the DNA analysis service provided by Superhlth.

Nothing in this Article limits any mandatory rights that the Customer may have under applicable law.

Article 9. Right of Withdrawal

9.1 General

A Consumer who concludes an Agreement at a distance generally has the right to withdraw from the Agreement within fourteen (14) calendar days without giving a reason, subject to the statutory exceptions.

For Products, the withdrawal period begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, physically takes possession of the Products.

The Consumer must inform 4Gold of their decision to withdraw before the expiry of the withdrawal period.

The Consumer may exercise the right of withdrawal by contacting 4Gold using the contact details provided on the Website or by using the applicable statutory model withdrawal form.

9.2 Return of Products

Following a valid withdrawal, the Consumer must return the Products to 4Gold without undue delay and, in any event, within fourteen (14) calendar days after communicating the withdrawal, unless applicable law provides otherwise.

The Consumer bears the direct cost of returning the Products, unless 4Gold has agreed otherwise or applicable law provides otherwise.

The Consumer is responsible for any diminished value of the Products resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Products.

9.3 Sealed Products and Statutory Exceptions

The right of withdrawal does not apply in circumstances where applicable law expressly excludes such right.

In particular, the right of withdrawal may not be exercised for sealed Products that are not suitable for return for reasons of health protection or hygiene once their seal has been broken, where this statutory exception applies.

The right of withdrawal may also be excluded for other Products or Services where one of the statutory exceptions applies.

9.4 Refund

Where the Consumer validly withdraws from the Agreement, 4Gold shall reimburse the payments received from the Consumer in accordance with applicable law.

Unless applicable law provides otherwise, 4Gold may withhold reimbursement until it has received the returned Products or until the Consumer has provided evidence that the Products have been returned, whichever occurs first.

Where required by law, the reimbursement includes the standard delivery costs paid by the Consumer for the original delivery.

Any additional cost resulting from the Consumer having chosen a more expensive delivery method is not reimbursed.

9.5 Gut Support Subscription

The right of withdrawal applies to the Gut Support Subscription in accordance with the statutory rules applicable to distance contracts.

Each delivery of Products under the Gut Support Subscription remains subject to the applicable statutory rules concerning the right of withdrawal and its exceptions.

Where the Consumer validly exercises their right of withdrawal in relation to a subscription, the consequences shall be determined in accordance with applicable law.

Nothing in this Article limits any mandatory rights granted to Consumers under Belgian or applicable European consumer protection legislation.

9.6 DNA Analysis

The right of withdrawal for the DNA analysis is governed by the terms applicable to the agreement between the Customer and Superhlth.

As Superhlth is the contracting party for the DNA analysis, any request to exercise the right of withdrawal in relation to the DNA analysis should be addressed to Superhlth in accordance with its applicable terms and conditions.

Article 10. Legal Guarantee and Complaints

4Gold guarantees that Products supplied to Consumers comply with the Agreement and applicable statutory requirements.

Consumers benefit from the statutory legal guarantee applicable to consumer goods.

For new consumer goods, the statutory legal guarantee in Belgium generally applies for two (2) years from delivery, subject to the applicable statutory rules.

The legal guarantee covers a lack of conformity that existed at the time of delivery, subject to applicable law.

The Consumer must inform 4Gold of a lack of conformity as soon as reasonably possible and, in any event, within two (2) months after discovering the lack of conformity.

The Customer should provide sufficient information to allow 4Gold to assess the complaint, including, where appropriate, the order number, a description of the problem, photographs and other relevant information.

Where a lack of conformity is established, the Consumer is entitled to the remedies provided by applicable law.

The legal guarantee does not cover defects resulting from abnormal or improper use, improper storage, accidental damage, modifications made by the Customer or failure to follow instructions for use or storage, insofar as permitted by law.

Professional Customers do not benefit from the statutory consumer guarantee applicable to Consumers, without prejudice to any mandatory legal rights or expressly agreed commercial guarantees.

Article 11. Liability

4Gold shall only be liable for damage caused by a failure attributable to 4Gold and to the extent permitted by applicable law.

Nothing in these General Terms and Conditions excludes or limits liability that cannot legally be excluded or limited, including liability resulting from fraud, intentional misconduct, death or personal injury caused by a fault, or breach of mandatory consumer protection legislation.

Subject to the foregoing and to mandatory law, 4Gold shall not be liable for indirect or consequential losses, including loss of profit, loss of revenue, loss of business, loss of goodwill or reputational damage.

To the maximum extent permitted by applicable law, 4Gold's liability shall be limited to the amount paid by the Customer for the Product or Service giving rise to the claim.

4Gold shall not be liable for damage resulting from inaccurate, incomplete or misleading information provided by the Customer, or from failure by the Customer to comply with applicable instructions and warnings, except where such limitation is prohibited by mandatory law.

4Gold shall not be liable for acts or omissions of independent third parties, including carriers and payment service providers, except to the extent that 4Gold is legally responsible for those acts or omissions.

In particular, and subject to mandatory law, 4Gold shall not be liable for the performance, accuracy, availability or results of Third-Party Services provided by third parties such as Superhlth.

Nothing in this Article affects the statutory rights of Consumers.

Article 12. Termination and Suspension

4Gold may suspend or terminate an Agreement where the Customer materially breaches these General Terms and Conditions or fails to comply with an essential contractual obligation, subject to applicable law and, where required, prior notice and an opportunity to remedy the breach.

The Customer may terminate an Agreement where 4Gold materially fails to perform an essential contractual obligation and fails to remedy that failure within a reasonable period after being notified, subject to applicable law.

The Customer may cancel the Gut Support Subscription in accordance with Article 7.

Termination or cancellation does not affect rights and obligations that, by their nature, are intended to survive termination, including provisions concerning payment obligations already accrued, liability, intellectual property, privacy and applicable law.

Article 13. Intellectual Property

All intellectual property rights relating to the Website, Products, branding, trademarks, logos, photographs, texts, designs, software, databases and other content made available by 4Gold remain the property of 4Gold or its licensors.

The Customer may use the Website and its content only for personal and lawful purposes in connection with purchasing and using the Products and Services.

Without the prior written consent of 4Gold, the Customer may not reproduce, distribute, modify, publish, commercially exploit or otherwise use 4Gold's intellectual property beyond what is legally permitted.

Nothing in these General Terms and Conditions transfers any intellectual property rights from 4Gold to the Customer.

Article 14. Privacy and Personal Data

4Gold processes Personal Data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Further information about the processing of Personal Data, the purposes of processing, the legal bases, retention periods and the rights of Customers can be found in the 4Gold Privacy Policy available on the Website.

The Privacy Policy forms a separate document and is not replaced by these General Terms and Conditions.

Where a Customer purchases or uses a Third-Party Service, the processing of personal data by the relevant third party is governed by that third party's applicable privacy policy and data protection information.

In particular, the processing of genetic data and DNA samples in connection with the DNA analysis is governed by the applicable privacy documentation of Superhlth.

Article 15. Force Majeure

4Gold shall not be liable for failure or delay in performing its contractual obligations where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include, without limitation, natural disasters, fire, epidemics or pandemics, war, terrorism, governmental measures, strikes, labour shortages, significant disruptions to transport or logistics, failures of infrastructure, shortages of raw materials, supplier failures and other circumstances that could not reasonably have been foreseen or prevented by 4Gold.

During a force majeure event, 4Gold may suspend its performance for the duration of the event.

If the force majeure situation continues for an unreasonable period and prevents substantial performance of the Agreement, either party may terminate the Agreement in accordance with applicable law.

This Article does not affect mandatory consumer rights.

Article 16. Special Conditions and Promotions

4Gold may issue additional terms for specific Products, promotions, discount campaigns, gift cards, loyalty programmes or other special offers.

Where applicable, such special conditions will be communicated to the Customer before the Agreement is concluded and will apply in addition to these General Terms and Conditions.

In the event of a conflict between these General Terms and Conditions and specific promotional terms, the specific promotional terms shall prevail only with respect to the relevant promotion.

Unless expressly stated otherwise, promotional offers cannot be combined with other discounts or promotions.

Article 17. Complaints, Disputes and Applicable Law

Customers may submit questions or complaints to 4Gold using the contact details provided on the Website.

4Gold will endeavour to handle complaints within a reasonable period and will inform the Customer where additional time is required.

These General Terms and Conditions and the contractual relationship between 4Gold and the Customer are governed by Belgian law, without prejudice to mandatory provisions of consumer protection law applicable in the country where the Consumer resides.

Any dispute between 4Gold and the Customer shall be submitted to the competent courts in accordance with applicable law.

Nothing in these General Terms and Conditions prevents a Consumer from exercising any right to bring proceedings before a court that has jurisdiction under mandatory applicable consumer protection rules.

Disputes relating specifically to a Third-Party Service shall, where applicable, be governed by the terms and conditions of the relevant third-party provider.

Article 18. Amendments to the General Terms and Conditions

4Gold may amend these General Terms and Conditions from time to time, in particular to reflect changes in legislation, Products, Services or business operations.

The version applicable to an Agreement is the version in force at the time the Agreement is concluded, unless a subsequent amendment is required by law or is otherwise validly agreed with the Customer.
